In a constitutional democracy, the rule of law is not an abstract concept; it is the bedrock upon which public confidence in our institutions is built. It is the principle that no one is above the law, and that a court order, once issued, is a command to be obeyed. Yet, in the ongoing saga of the Hampstead property at 7 Winnington Close, HM Land Registry (HMLR) appears to be operating outside of this fundamental principle, creating a legal and political crisis that reaches the highest echelons of government.
The facts, as revealed in a series of court documents and correspondence, are as startling as they are straightforward. HMLR, a government agency reporting to the Secretary of State, initially accepted a High Court order in 2012 to unilaterally vest a property's legal title in the State of Libya. This action was later revealed to be based on a fraud on the court. Now, in 2025, after the fraud has been judicially admitted and two new consent orders have been issued to rectify the injustice, HMLR is refusing to reverse its decision.
An Untenable Legal Position
The Land Registrar's position is legally untenable, bordering on the absurd. A letter from the Trust's legal team has cogently demonstrated a blatant double standard. HMLR's refusal to accept the current order on the basis that it "at most refers to the beneficial interest only" directly contradicts the precedent it set for itself in 2012. The original Popplewell J judgment, which HMLR relied on to remove the Trust's title, explicitly referred to a "beneficial interest" before ordering the conveyance of the legal estate.
HMLR cannot have it both ways. Its actions expose a choice: either its original decision was flawed and must be rectified, or its current decision is a deliberate obstruction of justice. This is not a complex legal puzzle; it is a clear-cut case of an agency refusing to correct a grave error, despite being presented with binding court orders. This position opens HMLR up to a highly damaging legal challenge.
The Political Ramifications for Steve Reed
This is where the political dimension becomes critical. HMLR is not an independent entity; it is led by interim Chief Executive Iain Banfield, and is ultimately accountable to the Secretary of State, Steve Reed. The refusal to comply with a court order is, by extension, a refusal by a government agency.
Secretary of State Reed now faces a political and constitutional quandary. If he allows this to continue, he tacitly endorses an agency that undermines the rule of law. This could have severe consequences for national and international confidence in the integrity of HMLR. The sanctity of the land register is paramount to a stable economy and the security of property rights. A perception that its processes can be manipulated or ignored at will by its own officials, regardless of a court's command, would be devastating.
The Trust's potential legal avenues, such as an application for a mandatory injunction or a judicial review, would put this issue on a collision course with the government. A mandatory injunction would be a direct order from the High Court compelling HMLR to act, essentially forcing the government's hand. A judicial review would examine the lawfulness of the Registrar's decision, potentially leading to a finding that HMLR has acted unlawfully. Both scenarios would be a major embarrassment for the government and Secretary of State Reed.
For Steve Reed, the choice is clear: he must act decisively to ensure HMLR immediately reverses its indefensible position and complies with the court orders. To do anything less would be to signal that under his watch, a government body is permitted to act as its own judge and jury, with catastrophic implications for the rule of law and public trust. The time for HMLR to correct its error is now, before the courts are forced to do it for them.
