LONDON, UK – 20 February 2020 – Marston Holdings, a prominent debt collection business, is facing severe accusations of engaging in fraudulent practices, bullying, trespass, and harassment. Financial Fraudster News Investigations can reveal that the company allegedly targeted unwitting individuals, not linked to the original debt, and acted without proper authorization from the creditor, who themselves had expressed concerns about the debtor's address.

This expose sheds light on what appears to be a systemic failure by Marston Holdings to conduct essential due diligence, leading to alarming instances of alleged unlawful enforcement.

Breach of Law and 'Sharp Practices' Exposed
Marston Holdings has come under intense scrutiny following a blatant breach of lawful procedures. The debt collection giant stands accused of failing to carry out the necessary checks required of a competent debt collection operator. Agents are alleged to have engaged in "sharp practices" due to the business's failure to conduct proper verification prior to visiting an address, thereby undermining the legality of their enforcement processes.

The Vambery Road Incident: A Case Study in Alleged Misconduct
In September 2019, concerns were raised by the property owner of an address at Vambery Road, SE18. It became apparent that a fraudster, identified as Mr. Maurice Smith, was illicitly using the homeowner’s address as a repository for his unpaid debts. This alarming discovery led to a visit by a Marston Holdings agent, Mr. Oromz, who purported to enforce the collection of these debts.

Upon being contacted by the property owner, the creditor's legal team launched an investigation. Following this, the creditor gave written notice to the property owner that all enforcement action had been suspended indefinitely, with a promise to keep the property owner, via his legal representative, informed of any changes.

However, in a shocking disregard for this explicit suspension, on 4 February 2020, Marston Holdings sent employees to enforce the collection of the very debt that the creditor had suspended any action or collection processes on.

Bullying, Trespass, and Fraudulent Representation
The situation at Vambery Road rapidly escalated. Marston Holdings agents engaged in what is described as harassment, persistent door-knocking, and shouting in an attempt to gain entry. They allegedly misled the two daughters of the property occupier, falsely stating that the address, and not the person, was responsible for the debt. The Marston Holdings agents brazenly claimed that "the debt was on the address not on the person."

The occupier of the property was contacted and arrived to find herself facing threats of goods removal, coupled with escalated fees, for a debt to which she had no connection. These actions were perpetrated by "over-zealous and trespassing Marston employees" who had allegedly fraudulently obtained access into the property.

The alleged fraud by Marston Holdings agents continued. Under the direct threat of goods removal, the agents demanded payments, leaving the occupier with "little choice but to pay £1,627.50."

The homeowner, upon being contacted by the distressed occupiers, expressed shock that Marston Holdings, without lawful authority from the creditor, sought to use unlawful means to access the property and demand payments for a debt that was not owed by the occupier. This was compounded by the agents' alleged fraud by false representation to the occupiers that the debt was against the address, not the person.

The Financial Fraudster News Investigations Team spoke directly to the occupier, who recounted her harrowing experience:

"Marston Holdings bullied, lied and defiled my home with their presence and demanded money like bullying gangsters. While they were here unlawfully after harassing my family, my daughters were studying. I pay my bills and those @#&%*#! threaten to take goods from my home, and I now find out they failed to do their jobs properly, they were there unlawfully. I have little choice but to start legal proceedings."

Further corroborating the alleged misconduct, on 19 February 2020, the creditor's legal team confirmed that no lifting of the September 2019 suspension had taken place, and that the creditor was deeply concerned and actively investigating the matter.

Your Rights: What You Need to Know
This case highlights critical protections for individuals facing debt enforcement:

Peaceful Entry: If bailiffs have not entered your home before, the basic rule is they cannot come in unless you or another adult lets them in. They can enter without your permission only if they can do so without using force, such as through an unlocked door or open window. This is known as "peaceful entry."

Forced Entry: Bailiffs are generally allowed to force their way into your home only in specific situations (e.g., for unpaid criminal fines or collecting income tax or VAT). If they do so when they shouldn't, you can complain to the police or the organization who instructed the bailiffs.

Complaints: If a bailiff is enforcing a County Court Judgment (CCJ) and they break the rules, you can complain to the relevant court. If they are a trade association member, you can also lodge a complaint with their association.
